As Banks saw it, Fairley had been caught in a web of surveillance, gentrification, and racism, in which vigilante neighbors targeted her for anything that went missing, when, in fact, many other porch pirates were also stealing in Potrero. Her lawyer filed an appeal, which is ongoing as of this writing, arguing that each stealing spree should have constituted a single conviction, rather than each stolen item. She might have stolen some items, but not everything she was being blamed for taking. The question was simply: Did 12 jurors think Fairley once had heroin in her possession and had stolen some items?
